Around a month ago my wife was at the car wash, the car in front of her was told to put it in Neutral so the machine could pull her car through. She instead put it in reverse and backed into my Wife's car. The Car wash attendants were waiving their arms and yelling no. My wife saw her reverse lights go on, her car was only a few feet in front so she didnt have time to hit the horn.
The girl driving the car got out and said her car was in neutral, my wife pointed out that her reverse lights were on.
My wife made the mistake of not filing a police report but did get the names of the 2 guys at the car wash that witnessed the incident along with the insurance info from the girl. She thought it was petty and didn't want to waste the time of the police (Lesson Learned!!)
Soon after, my wife opened a claim with her insurance company. They said they would speak with their client and get a statement. A week or so later my wife called and they said she was not returning calls. She continued to follow up on status and they said they were unable to reach her. My wife called back today and they were finally able to reach her and the girl denied the incident. My wife asked she would have received this girls insurance info if this incident had never happened?
The damage was relatively minor but getting the bumper fixed is still several hundred dollars from the quote the body shop estimated.
We have not yet reached out to the car wash to try in get in touch with the 2 guys that witnessed this.
Please advise on how to proceed. Would small claims court be our best option? Thanks again!
