attempted eviction of tennant

I am trying to evict a woman from my mobile home. The original agreement was that she would spend $200/month fixing up the mobile as it needed repairs. There have been no repairs made, no electric/water paid. Garbage was strewn all over the road which if had not been cleaned up by helpful neighbor I would have been sited for as landlord even thou the trash can is 30' from her door.
I went to the court house and got an eviction notice and paid the $170 court cost. Then I paid another $70 for the writ of possession. Meantime I find that she has responded to my suit. The first letter I sent her I itemized owed monies, told her if she would leave voluntarily within a few days I would wave all monies owed. The mobile has roof leaking, hole in the bathroom is getting worse as each time they take a bath it is getting worse, rainy season is here and the needed repairs are causing more damage. I cant get in to makes repairs. She sleeps during the day, works nites. The law says I have to give her a 12 hour notice and make repairs between 7:30 am and 8:00 pm.. I cant get access to make the repairs. How do I get her out? She refuses to pay rent, make repairs, allow me to make repairs, and now I am having to hire an attorney & pay court costs. How do I get rid of her?

You're doing the right things. Legally, you can enter the mobile between 7:30am & 8 pm, if you've given her 12 hours notice, regardless of whether she's sleeping or not. You need only give notice; she does not have to agree to your entry. The law was written by people who work days!

Give her written notice and let the workers in. If she's changed the locks on you, call a locksmith & have him/her make you a new key or replace the lock. If you replace the lock, you MUST get her a new key immediately. Drop it off at work or hang around until you see her. If she starts threatening you, call the police and have her arrested. By the way, assaulting or threatening your landlord is automatic grounds for eviction. Maybe she'll get so tired of having repairmen trooping through her place when she's trying to sleep that she'll move on her own. She cn't claim that you're constructively evicting her because these are all emergency repairs that must be done right now to prevent further damage to the mobile.

All your costs get added to your judgment. You'll end up with a big judgment -- rent, utilities, damages from her not doing her repairs, damages that would have been prevented if she had allowed you access to repair, the $200 she didn't spend, court costs, attorney fees. I'd be suprised if it doesn't hit $4,000. After you have the judgment, you can garnish her wages at work.

Yeah ive knonw Lots of jerk landlords like you, Im glad I always had money to pay enough rent so when something broke the landlord was not an alcohlic or drug addict and had the money to fix it........geez
