Aunauthorized Bank Hack

I AM FROM BALTIMORE MARYLAND.
i had 200$ drawn from my checking account without my authorization.
when i found out the company who did it. they told me it's for an insuance fee and it can be canceled with 30 day money back guarantee. i asked them to cancel it and return my money they said that a package had been sent to me they had to have it back before i get my money back.
now it's been 2 month i havn't seen neither the money nor the package. what should i do?

Go to your bank and file a complaint/investigation with your proof for unauthorized withdrawal. The bank should be able to investigate this (similar thing happened to me). They investigate and should credit your account, then they go after if they wish, the guilty party, on account they find that it was unauthorized.

Certainly the bank will know that answer. You should ask questions. Also, since this happened to me one time, usually just the mere fact that you complained of an unauthorized action on your account would weigh heavily on your side and they would give you credit to the account (they did for me).

AFTER ALL THE BANK IS JUST ANOTHER IRRSPONSIBLE COMPANY. ANY WAY I WENT TO THE BANK AGAIN THEY TOLD THE INVESTIGATON IS TURNED OFF BECAUSE THEIR POLICY IS I HAD TO FILL OUT THE AFFIDAVIT WHITHIN 60 DAYS FROM TRASACTON. NOW I AM RALY DISAPPOINTED WITH MY BANK BECUSE I DID GO TO THE BANK THE NEXT DAY OF TRANSACTION BUT WAS NOT GIVEN PROPER INFORMATION.
DO U THINK I SHOULD PRESS ON THE BANK TO DO SOMETHING I INTEND TO.
NOW I FEL NOT ONLY THEY FAIL TO PROTECT MY MONEY BUT ALSO LET ME DOWN.
AM I BEING UNREASONABLE?

Previously you stated that the bank promised you credit within 10 days,. Did you get this in writing? Did you do any of the complaint in writing? I would go back to the bank and do it in writing. I have never heard that you have an time period in which to file a complaint. I would ask to speak to who is in charge, then tell them that there was an unauthorized transaction in your account and if it is not taken care of then you will see them in court.

With the amount of money we are talking about, I feel that you would be able to take them to small claims court (check out your local court to see what the limit cap is).

That is all I can think of that you can do, short of sueing the original hackers in as well (you would have to have proof of course, and did you sign anything for an account with them before reading the agreements fine print? which could be there proof)

When was the actual withdrawal *and* the date of the first bank statement on which it appeared? Then flip over the statement to see if your bank goes by the "date of transaction" or "date of statement" method for disputes. If it's not on the back of the statement, you probably have to dig out the original paperwork from when the account was opened to see how disputes are handled.

I don't have "legal advice" to give, but on the back of all of my bank statements it states that you have 60 days from the *first statement* on which the transaction in dispute appears to notify the bank in writing. If they are unable to complete their investigation in 10 days of receipt of written dispute, I get the credit until the investigation is complete. After the 10 days, if it's in my favor, I keep the credit and if it's not in my favor, they take the credit back.

If I don't notify the bank *in writing* of a dispute within 60 days, it is *assumed* to be authorized and no dispute can be initiated after the time has passed. After that, I believe the bank is released from liability because they have laid out the procedure in writing and if I choose to dispute orally or not within the guidelines they have laid out, I'm out of luck.

It's in the information pack I got when I started the accounts and it's reiterated on the back each monthly statement. Actually, not with all of my banks... Two choose to lay it out every month and one orally refers back to the releases of liability from the initial information packet.

I feel bad for the poster because he/she went to the bank on the day following, but if you don't follow the procedures they set forth in the initial agreements then I don't know if there's going to be recourse available through the bank. If you're past the dispute period, they're going to laugh when you say you're taking them to court because they are going to have the agreement from when you opened the account laying out the dispute procedure. If you don't follow the procedure as they've laid it out, it probably releases them from liability.

If you're outside the dispute period, I'd find a new bank with better customer service (I love little banks!) and try going after the company that initiated the withdrawal.
