When was the actual withdrawal *and* the date of the first bank statement on which it appeared? Then flip over the statement to see if your bank goes by the "date of transaction" or "date of statement" method for disputes. If it's not on the back of the statement, you probably have to dig out the original paperwork from when the account was opened to see how disputes are handled.
I don't have "legal advice" to give, but on the back of all of my bank statements it states that you have 60 days from the *first statement* on which the transaction in dispute appears to notify the bank in writing. If they are unable to complete their investigation in 10 days of receipt of written dispute, I get the credit until the investigation is complete. After the 10 days, if it's in my favor, I keep the credit and if it's not in my favor, they take the credit back.
If I don't notify the bank *in writing* of a dispute within 60 days, it is *assumed* to be authorized and no dispute can be initiated after the time has passed. After that, I believe the bank is released from liability because they have laid out the procedure in writing and if I choose to dispute orally or not within the guidelines they have laid out, I'm out of luck.
It's in the information pack I got when I started the accounts and it's reiterated on the back each monthly statement. Actually, not with all of my banks... Two choose to lay it out every month and one orally refers back to the releases of liability from the initial information packet.
I feel bad for the poster because he/she went to the bank on the day following, but if you don't follow the procedures they set forth in the initial agreements then I don't know if there's going to be recourse available through the bank. If you're past the dispute period, they're going to laugh when you say you're taking them to court because they are going to have the agreement from when you opened the account laying out the dispute procedure. If you don't follow the procedure as they've laid it out, it probably releases them from liability.
If you're outside the dispute period, I'd find a new bank with better customer service (I love little banks!) and try going after the company that initiated the withdrawal.
