Hello,

My 341 is on Friday, 4/29..

Today my husband received a letter from one of my creditors stating that he was a joint user and responsible for the balance..

I don't remember him signing anything when I opened this account 15 years ago but did add him on as an authorized user...He is in his eighties and worried that they will take this money from his checking account and ask questions later...He only receives SS and a pension which I understand cannot be touched, but what if they do so anyway? He needs his money for his own bills.

Thank you to all who will respond...He called the bank and they were closed and my lawyer is not reachable until Monday.

You need to be sure he's on there ONLY as an AU. AU's are NOT responsible for the debt, only the primary card holder is liable. Its not uncommon for some of these banks to list AU's as joint when they are not.

Your husband's income is exempt from siezure. No one can sieze anything w/o first suing and winning a judgment. IF they went that far, then you would insist that they produce his signature on ANY binding agreement.

I will call my lawyer Monday and also the card company and ask for them to fax the credit card agreement signed by me and supposedly my husband....

I am assuming that they would do that (fax) Am I wrong?

Any and all contact with the creditor should be by certified mail, return receipt requested. And something else to be aware of, many credit card companies have changed their terms of use to include anyone signing for a purchase with the credit card can be held liable for paying the bill if the person the credit card was issued to does not pay. That is allowed by a little publicized law signed by president shrub last year. It is part of his agenda to make his buddies in business and high finance happy while screwing the little folks like us. The check payment reform bill and new bankruptcy bill are other examples that the republicans taking us for a ride.

That's for damn sure !! :mad:
People need to be made aware of these 'bend-over' bills, they are certainly NOT doing the general public any good at all. People should know that being designated as an AU can get you screwed. It also needs to be shouted from every possible outlet how BAD bankruptcy will be in 6 months. People who are on the edge, have borderline or no health insurance, middle-aged or older (higher medical and Rx costs in this group), should be dumping plastic like its infected with plague and closing/cancelling every damn card they own. The credit card banks are licking their chops and frothing at the mouth waiting for this new BK law to take full effect. Credit cards now, for all but the well-heeled, very well insured, and those with GUARANTEED EMPLOYMENT should be avoided - IMO ! :mad:

To Ladynred and Racer72 and all,

I called my lawyer today and he called the credit card company...He was told it was a joint account...I believe when I asked them to add my husband on as an authorized user the agreement they said he signed made him a joint account holder.

My lawyer told them that since my husbands income was from Soc. Sec. they could not touch it and besides he was elderly and not well. They asked for a fax of a driver's licence or birth certificate to prove his age and it all went away.. They can't get anything from my husband and I am discharging this bill in bankruptcy at the 341 this Friday.

I will let you all know how it goes on Friday....Am scheduled for 11:30 a.m.
Can't wait til it's over...

The lawyer and paralegals I have had have been extremely helpful and easy to talk to. Bless them.
