I was in an auto accident Jan. 19, 2000 where another drivert ran a red light and totalled my car. i recieved medical treatment untl the end of May 2000. The other driver was found liable in a court of law in April 2000. All the information required has been sent to the insurance company. I feel like they're just dragging their feet and I feel like my lawyer isn't doing all they can to get this settled. When I speak with my lawyer they give me the runaround and sometimes they don't accept my calls. The accident put me in really bad financial situation because I wasn't able to work. I need this settled quickly. What course of action can I take with the insurance company and even my lawyer?

My response:

Actually, the amount of time so far is fairly typical. You only recently completed your medical treatments, and it does take 2 to 3 months to finally settle a case to the mutual satisfaction of both the client and insurance company. Negotiations is an art, and shouldn't be rushed. Remember, the one who "blinks" first, loses.

However, if you are willing to accept less than what you claim is probably worth, your attorney can settle it today. All you need to do is write a letter, or send a fax, to the attorney and say, "Settle my case today for whatever you can get above my medical expenses. I will hold you harmless for settling my claim for less than it may be worth."

If the insurance co knows you in a hurry to settle and that you need the money, the value of a settlement has just gone down as they will use that info to their advantage. the time it takes is not unusual and can take longer; remember, if not agree on a settlement, the option is starting a suit.
