Hello. I was wondering about insurance claims and adjusting. We were hit by someone. His insurance agreed he was at fault. The door of my car is dented. The adjuster looked it over and gave us our claim estimate and a check. On the estimate, the adjuster wrote for recycled or used parts. I called them and told them that I don't want a door off of another 2005 vehicle that was invloved in a crash, or recylced or used parts. They gave me some song and dance that they are not required to pay for a new door or parts, only to pay for a door and parts of like value as mine. They also tried to tell me that just because the door came off of a vehicle that was involved in a crash doesn't mean that this particular door or parts are damaged. It was just coming from a damaged vehicle. Is it lawful and within the car insurance companies rights to say they are not required and will not pay for a new door and parts? They are telling me that if I want a new door and new parts that i will have to pay the difference. Is there anything I can do? Please help if possible. Thank you for your advice.

Of course it's legal. Though your door was undamaged before the accident, it was not new. You are entitled to an undamaged door, but not a new one, because that is not what you had before the crash.
