First of all - this is a Missouri case.
My son's car was struck in a parking lot. He backed out, had stopped, and was struck before he could start forward (after honking the horn I might add). He was struck by a vehicle backing out opposite to him. The car was struck directly in the rear passenger door. He has witnesses to all of this.
The problem is that the damage is less than his deductible. Am I wrong to think that it is useless to file a claim against our insurance company?
The other person's Insurance is giving us the run around. I am considering taking the at fault party to small claims court, or at least threatening this. Any suggestions ?
