My daughter (over 21yrs) was injured when the driver she was with fell asleep at the wheel and went into a tree. The driver had $5,000 medical insurance and the insurance company issued my daughter a check for that amount. They told her she could spend the money on airfare to return home. Is that appropriate? I would have thought medical coverage would be intended only for medical expenses. Her medical expenses at this time exceed $50,000. Also, is it likely the insurance company will volunteer some kind of settlement? Thank you for your help!

My response:

Gee, I hope your daughter is on the mend and doing better. With 50K in medicals, it must have been a horrendous accident.

I liked your statement that included "insurance" and "volunteer." That's akin to "military" and "intelligence."

It is, however, with such heavy medical expenses, that the insurance company will, at some point, make an offer that will be low, and will finally cause you to obtain an attorney - - which you should do immediately.

As far as the med-pay is concerned, the insurance company's obligation is to pay out up to the maximum of its medical pay of 5K. What you do with the money is strictly up to you - - use it for airfare, buying a swimming pool, a car, etc. It doesn't matter to them. As long as they've done their part under the Insurance Code, the money is yours.
