I was involved in an auto accident on the freeway in California where I was rear ended, I rear ended the car in front of me and then that car rear ended the car in front of him. The car that hit me drove away before I was able to get any information and the other drivers say they "do not remember" the car behind me. My insurance company said that the car I was driving is not on my policy. There was minimal damage to all of the cars. Now the driver of the first car has hired an attorney to seek "claims for injuries sustained" and the letter that his attorney sent me says that I was the only other person involved in the accident. Question one: is my insurance company in any way responsible for any help to me?
Question two: should I respond in any way to the attorney's letter which again, stated I was the only other person involved in the accident (my car in fact never touched the sueing party's car)?
I am in California.
Thank you!<HR></BLOCKQUOTE>
My response:
It stands to reason that if a vehicle rear-ended you, then there would be discernable damage to the rear of your car.
If the vehicle you were driving was not a "covered vehicle" then no, your insurance company has no responsibility to you.
The attorney is saying that you are the legal, proximate, and efficient cause for the accident - - i.e., no one believes your "phantom vehicle" story.
Your vehicle didn't have to touch the "suing driver's vehicle." The facts are that, for whatever reason, your vehicle was a cause for having caused "other" vehicles to be pushed into the front vehicle (suing vehicle).
The other party's insurance companies will pay those partys under their Uninsured Motorist Provisions of their policies; however, their insurance companys will eventually come after you for reimbursement for all monies paid to their insureds.
If it turns out that you don't have coverage, you'd better look into obtaining a defense attorney for yourself or, perhaps, a good Bankruptcy attorney.
