I was rear-ended on a busy interstate 1 week ago and the person who hit me has not contacted her insurance company. I called them adn filed a claim, but they will not do anything about this unless she contacts them and I don't think this is right because there is a police report proving that her car hit my car (and totaled it). My question is if this is correct. I only have the lady's name and driver license number because that is all that is on the police report. Texas.

My response:
It is correct. However, once an insurance company receives a report of an accident involving one of their insureds, that does not mean they "sweep it under the rug". They must attempt to make contact with their own insured to gain information on the matter. But, until they do, they don't have to deal with you.
I strongly urge you to see an attorney concerning your other rights in this matter.
