Auto Accident-Negligence on PA State School Property

My daughter was at college where a lot of contruction going on. She hit a dark unsecured gate where there was poor lighting. She substain a fractured jaw in two places as well as several leasions in the facial area. What should I do?

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

Well, in this case, there are two possible defendants....the construction company who was hired to do the work and the school.

The construction company has an absolute duty to sufficiently make the area around the construction site safe....i.e. warning signs far enough in advance, extra lighting so people can see, etc.

The school is responsible because they hired these peeople.

I would perhaps talk with an accident attorney in your state about this. The only thing I am concerned about is the 11th Amendment protection of the state against suits by Citizens for monetary gain. 11th Amendment is not one of my strong suits, but I would imagine this might be a concern since the state school might be an arm of the state? I.e. unless state/school consented to waive immunity from state, you may not be able to sue?

Well, then our writer's daughter files a State "Claim for Damages", and then she's off and running in the litigation. No biggie.
