I was wondering if anyone has any advice for me..I have a lawyer and have been told that I can only sue for 25,000.00. For the accident that not only was not my fault but I have lost a residential cleaning business that I had started. Because, of injuries inquired in the accident. The person that hit me was drinking and on the scene of the accident was charged with DUI but, the breathalizer was not working (kinda funny this is the second time the man has been charged and the system failed. I need to know if I can file a civil suit against this gentleman who did this to me. I am still under doctors care and cannot go back to work yet and it's been a year and 3 months.
Any help would be appreciated.

in my experience. You can only sue for what ever the other driver's policy limits are. If the policy limits are only $25,000 that is all you are going to get. be sure and check for any umbrella type policies, excess coverage policies, etc. In addition, if the other driver has any assets, you can sue for the fair market value of his/her assets. If you have UM coverage on your own policy, you may try to recover the remainder of your damages with that. a UM claim will not affect your insurance premiums. Good luck!!
