Auto Accident, what are my rights?

I was involved in an auto accident not too long ago. I was not at fault. Police reports and witness reports show this. However, The girl who hit me is uninsured. My brand new 2001 car that had less than 3500 miles on it was considered a total loss. But because it was so new, and my insurance company paid what the car was worth at the time, I am left still paying on a car I will never see nor use again.

I am now carless. Also, my PIP plan covers me for $10,000. However, my hospital bills alone come to over $8000.00 because of a cat scan etc to check for internal injuries. I have been left with physical and emotional damage, diagnosed with PTSD, and seeing a chiropractor for my back and neck, and I am confused as to what happens when I hit my $10,000 limit. Do I just have to stop treatment and live with my injuries forever? Or can I continue? I cannot afford to continue if I am not covered!

I was not working at the time, but I had interviews lined up for the next couple of weeks, all of which I had to cancel due to the accident. I am not able to work right now, I have so many doctors appointments, forced to pay for a taxicab to all of them. Please advise as to what my rights are, and what I can possibly do.

. . . and everybody bought the insurance company's pre-election advertising, Hook, Line and Sinker, that "No Fault" insurance was the great "Answer" to the Tort Law "problem" and to keep attorneys from causing insurance rates to rise. Then everybody, just like sheep, voted in favor of "No-Fault" insurance.

Well, here's a writer who is a fine example of the problem with "No-Fault".

Gee, where's the insurance companies now ?

There's nothing anyone can do for our writer - - except to say that the next time "No-Fault" comes up on the "Ballot", to vote against it, and bring back the old Tort law system of "Fault" back.

I agree that everyone thought that the great magic solution to the Tort Law problem was the No-Fault insurance.
The concept may have had a slight chance to work if all the road hogs and road rage drivers that were involved in accidents had insurance but a good majority of the drivers around either are uninsured or under-insured.
The writer does have one option though and that is to hire a PI attorney to sue the driver/car owner.
