Auto Accident--What can we do?

My husband was in an accident with our 6-month old car. The other driver was at fault and our car was totaled. We are in a bad situation. When we purchased the car, we received a $2,000 rebate, had a low interest rate loan and my husband was working. Right now, my husband is out of work and has been for the last six weeks which will make it impossible for us to get another car loan. Also, the interest rates are higher and they no longer make this vehicle. The replacement model for this car costs a few thousand more and it also has no rebate. Is there anything we can do in this situation or will we have to settle for the replacement value of the car and have to live without a car until my husband has a job?

Generally the damages one can recover for the property damage to a car are either the repair cost ( if not totalled) or the fair marke value of the loss. Publications such as Kelly's Blue Book ( www.kbb.com) are standard resources for such matters. It may be worth while at east hiring an attorney for an hour or two of work to advise you and perhaps write a letter on your behalf.
