I think there should always be a need of consulting with an attorney. But, if I have just car damage and other types of property damage only, I don't use an attorney. However, because there is physical injury and you DO have pain and suffering, I suggest you consult with a personal injury attorney. It says you the time and hassle of dealing with the insurance company. Not only that, but most insurance companies, when they think they are dealing with a non-attorney, truly low ball the settlement and don't treat the accident victim really well.
Start off reading the auto accident articles and related insurance subsections at freeadvice.com's home page and then consult with an accident/personal injury attorney in your state at attorneypages.com. If you can't find one there/need to double check his/her references, contact your STATE BAR ASSOCIATION (call 411 and ask for your state bar) and then go from there. BUT DO THIS AS SOON AS POSSIBLE.
