My daughter was in an auto accident. She was driving down a 4 lane hwy and merged over to the right turn lane. The second driver pulled out from a fast food restaurant and hit her in the side causing the air bags to deploy and burned both her forearms. She filed her insurance only to learn that she had let it laspe. The other persons insurance company said since she had no insurance that they did not have to pay. She got her car fixed because she has to go to work. Can she sue for the cost of repairs, attorney fees and court cost?

Yes, Having or not having insurance does not decide who caused the accident.

I’m not sure about the law in Alabama, but most have a law saying when entering a main roadway you must yield to vehicles already in the roadway.
