Auto Accident

My husband was involved in a car accident on March 18. The other driver ran a red light and hit our car. We have a witness that says my husband had the green light. Needless to say our car is not drivable at this time. My husband received a neck injury. He was out of work for a week and a half. Also we had to rent a car which came out of our pocket. We are out of at least $1000.00 at this point not to mention the medical bills. We have been in contact with both insurance companies. They say that they are waiting for the police report. They say they can't do anything until they receive it. We keep calling the policeman that did the accident report and he told us that he hasn't finished it yet. When we spoke to him 2 weeks ago he was going to try to finish it and get it out. Last week my husband talked to his superior and still didn't get anywhere. It's been almost 2 months!!! We keep calling the policeman but he won't return our calls. What can we do to get this ball rolling? Is there any legal action we can pursue??
We live in Vermont.

You hire a Personal Injury attorney. THAT'S how you "get the ball rolling".

We did call a lawyer and he told us that even he couldn't do anything until he got the accident report. He told us to try to settle it with the Insurance company ourselves.

That is the most rediculous thing an attorney could say. Perhaps, the attorney you spoke to wasn't "hungry" enough.

Call another. To leave you "to the wolves" is assinine, because you don't know the laws. You don't know what to say, and what not to say. You need guidence, and without guidence, you're bound to get screwed. An insurance adjuster just loves it when someone represents themselves, and then laughs all the way to the bank.

He told us that in most cases the insurance company would rather settle out of court than deal with a lawyer. How much do these lawyers anyway. I don't want to end up owing a mess of money to a lawyer when I'm trying to get reimbursement for all my expenses.

My response:

Most every Personal Injury attorney takes such cases on a "contingency fee" basis. That means, they don't get paid unless they get you a settlement or judgment in your favor.

So, nothing is going to come out of your pockets for hiring an attorney. They take a percentage of your settlement or judgment.

Go get one today.

I'm afraid of this taking too long to settle. I need a car right now!!! I'm borrowing one from a friend right now. We don't have the money to go buy a car. It's not fair . The other guy is at fault. But yet it's going to take forever to get our settlement isn't it?

I've already told you what to do. It's up to you. I can only tell you so much, and then it's up to you. If you want to keep wasting time, that's up to you. But, if it were me, I'd already be in an attorney's office.

You're getting nowhere fast doing it on your own. Get some "clout".
