About 6 months ago I knocked over a fog lamp to a vehicle that was parked behind me (we were parallel parked). In the city I live in parking is limited and it is very common to be parked bumper to bumper. Since that was the situation I had to get up to both the car in front of me and the car in back of me right up to the bumpers to get out of the parking spot. In the process I knocked off the person fog lamp parked behind me. I did not even have me car in gear. I knew the owner of the vehicle and approached the person and sail I had done the damage to the fog lamp and was willing to pay for it. I left my name and number. I had asked the person to come out and view the damage but they did not have time at that time. So I left. Within two weeks I received both vmail and by snail mail estimates that were in the $1300-1600 range. I called a dealer repair shop and found out the fog lamp would only cost $100 to replace. I refused to pay the outrageous claim and now the person is suing me in court. Facts: I was the only witness, no police report was filed, I volunteered to pay for my damage. My questions: how can the person prove that I was at fault? I am still willing to pay for the fog lamp, will the judge make me pay for all that is being claimed if I admit any guilt? What can I do/take to court to be prepared? Thanks so much!!
