i live in ny and purchased a used car in nov. the deal was i would trade in my car, on which i owed $2875 still, and get $2000 and would work the $875 i still owed into my new loan and the company i am buying the new car from would pay off the loan. well they screwed up the contract and gave me $2000 trade in credit but forgot they still had $2875 to pay off the loan. handwritten on the contract stated they would pay off the loan not to exceed $875. i pointed this out to the finance officer that it didn't sound right but he reassured me everything was ok the way it was. i left with a finance contract stating i would be paying $380+ a month for 60 months(i also purchased a warranty which was worked into the loan). in mid january i recieved a call from the sales manager stating they picked up an error on thier part and i owed them $2000 but because it was their error they would work out a deal with me. i came to an oral agreement with the sales manager believing he a authority to negotiate such a deal. i would pay $500 and they would eat the other $1500. i paid the $500 and was given a receipt stating this. unfortunately i never got in writing this agreement but trusted the manager. early last week i recieved a phone call from the owner of the dealership stating she noticed an error and i owed the company $1500 or i would have to bring the car back(i had already made payments on the car). i returned her call but failed to reach her, finally leaving message stating i had already worked out a deal with the manager and paid it. She called back the next day and left a meassage stating i knowingly took advantage of her sales manager in the amount of$1500 and he would have to eat the difference if i didn't pay(also stating the manager had 3 young kids at home). next i was called by the owner's husband stating i owed $2169(have no idea where this # comes from)and if i didn't want to pay it he would see me in court. the owner called again and put me in a three way conference call with the sales manager and the manager lied and said we never came to an agreement it was just a discussion we had. i said then why wouldn't they have put a balance due on my reciept if i owed more or drawn up a contract stating i would make payments? he is completely lying. the owner then said he worked out a deal with my bank and a new payment plan all i had to do is sign it by this week. i want to know if i have a case in court. i have the tapes and contracts. i also have contacted the vehicle manufacturer's headquarters and have a case# with them. is this the right route to go? is there anything else i can do?
