Car dealer took advantage of my "not-so good @ English" cousin. She was told she was co-signing for a realative and could remove her name after 4 months. 4 months go by and she finds out she is the ONLY person on the loan. So the nephew has now split and she is left with a car note and insurance for a car that sits in the garage. I told her she signed it, too bad. I also told her she should cut her loses and sell it. I then look up her pay-off...almost 30 grand! I look up the Blue book on the car...about 15!!! ( She purchased the 07' Sonata in Nov of '07. It had 30,000 miles on it.) So..somethings fishy. The dealership refuses to give her the paperwork. I get it from the finance company. They provided a "Like" invoice to the finance company that was not really LIKE the car. It had all kinds of options and equipment that her car does not have. (For example, the invoice says the car has all leather interior, her car has all fabric.) My question is, does she have any options? She just wants to be rid of the car w/o ruining her credit.
update: so I went in and showed the dealerhip the proof of fraud that I had. They told me that the dealership was under completely new management. They asked for a day to figure out how to fix the problem. After a WEEK, they agreed to buy the car back. They said they needed to see the car to make sure it was in good shape. I told my cousin to bring it in but NOT to leave it. They told her it looked good and they woud send the check out THAT day. they insisted that she HAD to leave the car. she made them write a letter saying that she was no longer responsible for the car and that they would be paying it off. 2 weeks later....it still has not been paid for....and they have the car. They now do not return my phone calls and the finance company says they have never spoke with them...although they told me the delay was caused because they requested more paperwork from the finance company, and dealings with them. The finance company says there is nothing they could do, we must discuss it with the dealer. They took the car and did not pay for it. would this be considered Auto Theft? WHAT NEXT?!?!
