I was in an accident in 1996 in Massachusetts in which I was driving a vehicle owned by another person. I was an insured driver on the policy. When the Insurance Company went to get a statement from the owner, the owner told them that she had sold or given the vehicle to me. The Insurance Co refused to settle, saying that the policy terminates upon transfer of ownership. My argument is that the vehicle was never sold or given to me, there has never been a receipt presented that indicates a change in ownership, and the DMV shows the vehicle is still registered in the other person's name, even to this day. The Insurance Co says that I must provide proof that I don't own the vehicle, such as a copy of the title. Of course, this is ridiculous - how would I have the title of something I don't own? It has gone on for four years, the owner of the vehicle will not cooperate, and the Insurance Co will not settle. Is my only recourse to try to sue the Insurance Co? Any ideas would be greatly appreciated.
