Auto loan CHARGEOFF...what now??

Summary: got autoloan, lost job, new baby etc, couldn't pay loan, now collections calling and writing.

Since then, I've been trying to figure out what to do about this. I called the original creditor to check the status of my account and they said it has been "charged off" and I asked them if they sold my debt to the CA and they said no but I would have to deal with the CA from here on out and not them. I also asked the creditor for a copy of my orginal contract with them because I moved and can't find my copy, and he said they couldn't give it to me, that I could get it from the CA. He was very rude. Of course I asked, "why can't I get a copy from you..don't you still have it?" He replied that they did but I would still have to get a copy from the CA!! I said, "so in other words, you don't want to deal with me at all do you?" He said, "no, unless you have a complaint about the collection agent, you'll have to deal with them."

I do have a problem with the collection agent actually..their latest thing is to send me a letter stating that a payment I had made did not clear my bank when in fact it did. They know it did!! I think it's a tactic to get me to call them.

First of all, do I HAVE to deal with this CA?? I want to fix this situation but I'm not sure how. I'd like to negotiate for a settlement. Is it true that the original creditor won't negotiate with me because they have to give part of what they get to the CA anyway? Any advice?
