My wife and I purchased a new car from a dealership on March 18, 2006. The dealer calls on March 24 to say that the original contract fell through and that they need us to sign a new contract. We thought no problem. The dealer had sent the new contract overnight to us. Since the dealer sent it overnight on Friday, March 24, the contract did not arrive until Monday March 26. My wife and I looked at the new contract and were appalled that the dealer had raised the APR and was now requiring a down payment.
We made plans to swing by the dealership to discuss the new contract on Tuesday, March 27. If the dealer was going to alter the deal, we were going to do the same. We had found out that the Kelly Blue Book value that the salesman/sales manager had shown us was inaccurate..it did not list the options on the vehicle, which made a difference of $570 in our favor. This day also was the day that my wife had an Obstetrician visit as she was already overdue for the birth of our daughter. Well the Obstetrician made us go directly to the hospital to induce my wife to deliver our daughter so we did not make it to the dealership that Tuesday. And then other problems started with the dealer.
This dealer kept calling both our home and my wife's work demanding that the new contract be brought back to the dealer. We were in the hospital and I was not going to leave my wife's side to go negotiate with the dealer once more. This dealer was even informed that my wife was in the hospital giving birth but still kept on calling.
We got out of the hospital on Friday, March 31. I got all my paperwork together including the two Kelley Blue Book values for my wife's trade and the no haggle price for the car off of the dealer's website. I arrive at the dealer on April 1 and state what changes I would like to make since they made some. My offer was given to the sales manager and thats when it hit the fan.
The sales manager along with the finance director told me that I could not make changes and that they were going to force our original financing through the original bank. Here again, this was Saturday April 1. I then told them that I would like to return the car. Here again this was not an option. I left the dealer.
That following Monday, April 3, I spoke with the General Manager for the dealership and got not further. He told me that the financing was pushed through that previous Friday, March 31 on the original contract. Now if you recall from above, on that Previous Saturday, the sales manager and finance director had stated that they were going to push the financing through on the original contract. I believe that this dealer forced the orginal contract financing only when I wanted to make changes to the second contract as they had.
My questions:
Can the dealer force the bank to push through your financing even though you had been denied through the same bank without your permission to do so? If so, is it legal? This dealer never called to tell us they had pushed through the financing with the original bank.
Does the dealer not have to wait for us to respond to the second contract before deciding to push through the original? My wife and I were in the hospital and quite frankly dealing with them was not a priority.
We have several issues with this dealer including the Selling practices, contract development, and harassment. We have contacted the corporate office and are awaiting a reply. We will never visit anothe TEAM dealership of any other brand of Autonation dealership. They are horrible!
