I bought a 1994 Ford Explorer in July 1997. From the beginning there were problems with the ignition. The dealer refused to fix them, stating that they found no problem. Finally, after having the car for less than a year, it wouldn't start at all. I told the finance company that I refused to pay for something that wasn't running, and they took it back. Now my credit report reflects a voluntary repossession as well as TWO finance companies that state they have written off a debt of $15,000. I have two questions:

1. If the companies state that they have written off the debt, can they still come after me for the money?

2. Am I eligible to file in one of the class action suits that are being filed against Ford for their faulty ignitions?

If I file a bankruptcy, is it possible to get rid of only this debt? Also, this happened before I was married, now that I'm married can I file a bankruptcy without getting my husband involved?

One last thing! When the dealer sold me this truck, they lost the documentation and I had to re-sign new documentation. The documents that I have are not signed in all places, would this void the contract?

you lisy debts on the bkrptc but it is still a bkruptcy in your credit report. now that you are married, it will reflect on your spouse's report.


a performance on a flawed writing will take it out of the written agreement requirement and is still unenforceable.
