Automatic Stay Question.. kinda.
What is the name of your state? NC
As of now, my car payment is up to date. I plan to keep it and keep making the payments without reaffirmation. However- I was just wondering how long the stay 'protects' me. My meeting is 10/12, with discharge being set for 12/12. I've been playing "catch-up" with my household bills all year, b/c I got behind when I was trying to make payments for cc's, and then got into the cycle of getting payday loans to stay afloat, which really effed me up. So now I've been continually having to use my overdraft protection to make sure everything gets paid. Needless to say, I'd like to stop... but that would mean that I'd have to 'skip' one month's car payment. So that I can get rent and car note off the same check. I don't plan on just not paying altogether- but if I skip next month, and just send them a check for say, $50, pick up next month with regular payments and extra $50 each check until the missed payment would have, in affect, been paid. Or just skip it altogether, and pick up the next month like regular (and hopefully have them tack it on the backend of the loan)- can they take action? I know in the real world they'd probably repo my car if I tried something like this- but since the point of me filing BK was to get a clean start.. I'd kinda like to do that and stop using overdraft.
