A pilot is chartered through a charter business he works for, however is hired to fly for a company that owns their own plane. The plane crashes all passengers and pilot are killed. The insurance of the company that owned the plane said the coverage did not cover the crew, the charter business insurance says they don't cover the pilot because he wasn't in a plane owned by the charter business. How could the owner of the aircraft not have insurance to cover all passengers including the pilot, I understand that NC law is not like auto insurance, however this company had no permanent pilot on payroll and was always chartering out pilots, how could the insurance company not cover? Please advise. thanks in advance sheila marie

My response:
We would need to see the insurance policy. Most State insurance laws allow various exclusions in policies, and rates are set pursuant to such exclusions, and other variables. If you can obtain a copy of the policy that was in force, then have the same reviewed by an attorney.
