I was behind on rent 1 month, (i have lived here for 10 mo's) I needed help so I put an ad in the paper and charged the 2 guys $500 a mo. on a verbal mo, to mo agreement.
I was late to court by 10 min. sat down and waited until I was last, the judge assumed I was late and said to me "this is your lucky day" I did extensive research to prove I was wrongfully evicted . The judge already knew what I found out (cause that is his job, i know) so my case was dismissed.
The lady who tried to evict me was in court before me and left immediately, she assumed that I was admitting guilt and decided to not show up.
This is what I typed to take to court w/me when I was summoned for a forcible detainer.
33-1371 - Partial payments.
I received warning on July 29th to pay $1,050 or eviction proceedings would begin by 9 a.m. AUG, 2nd Unless I can vacate the unit on FRI, AUG 5th then eviction proceedings would be stopped.

2 guys I meet through a classified ad, moved in at a rate of $500.
Judy was accepting partial payments, so I used $300 for utilities and food.
Before the end of the month, Judy confronted the new roomates of mine, and asked them for the rent and they personaly paid her $500.
I was working for judy (manager of condominums w/hoa members) doing misc. duties. I called from out of town, saying I wouldn’t be in and when I got back, judy hired Ryan Litton, to replace me and said you better start looking for a place.
At the end of aug, after she personnaly collected monies from the new roomates I then would only owe 825 for sept, and I had $1200 to give, w/ a check for $500 on the way in the mail.
Judy would not accept the $1200 + the amount from the new roomates which I assume was $500 as well. (she kept that money seperate, telling the guys they would sign a new lease once I was gone, even thought I let them move in to help me) That would have been enough for rent + $25
When she told me to find a place and would not take my money unless I had the full $1725.
I called the individual who was helping me, to cancel the check, because she would not accept anything but a money order.
I asked land lady for the check back, and she said she sent it on to the owner, when the check was written to her. I also asked for records of how much the two gentlemen paid and she would not tell me or show me proof, neither would they.
Tim said “AS FAR AS I’M CONCERNED I HOPE ALL MY MONEY GOES FOR NOVEMBER RENT AND YOUR STUCK W/THE REST”
I asked (land lord) to read a copy of the hoa’s CC’R’S (Covenants, Conditions and Restrictions) she refused saying they are only for the homeowners.
She was secretive about renting to me when board came around, When I was making partial payments, I asked for the name of the owner, so I could speak to him personnally, and she told me he lived in Australia, and that I could not speak to him.

Any contract entered into in violation of the conflict of interest standard is void and unenforceable.

Public records indicate there was an update on Oct 23rd, 2005 & By coincidence, I received my summons to appear in court On Oct 24th, 2005.
When I found parcel # 130-19-128-A The owner and managing agent on record were not correct

(AGENT) Colin Spring (INFO SAME AS ABOVE)
Also listed was JOHN DOE US INVESTMENTS INC.

I believe I was wrongly evicted, because two individuals paying rent are better than one struggling, Land lady WAS AWARE THAT THESE TWO GENTLEMEN MOVED IN ON SEPT 2nd.
After the second month they were there I would have been caught up w/rent and on my way out of town at the end of Nov, since I had two individuals to take over my lease.
last of all yesterday, (if I would of lost my case) I was to be out, the land lady told the roomates I was leaving, when they asked me when I got home that night why I wasn't out, I told them the truth about winning my case, and she was lying to them. they got angry and said I was lying and slammed the bedroom door on my arm, I pushed it off and broke part of the door jam.
The called the cops and lied and said I kicked in the door.
I have no reason to do this EVERYTHING in this condo is mine clear the the last cup. the cops came filed a report saying I kicked in the door (when I didn't) and the next day the door jamb was completley obliterated, an attorney for the land lady was called and some of my personall belongings were missing. The two roomates moved all of there belongings out (into the hoa's office on the premise) and Now I'm afraid I'm going to need some help. What do I do. Please help, If what I read about the law in az is correct, I could be in front of the judge in 3 days from tomorrow.
