Suddenly they wont give my prospective landlord a positive reference of me despite my demonstration of every positive quality a good renter can have, and Im sure they will try to milk me for every dollar they can.
Hello sir, My rent is due on the first of the month for that month (for example - rent due 01 OCT for the entire month of OCT, etc)-I am on a month to month lease (beyond 1 year turns to month to month) after fulfilling a total of 2 years and 2 months of tenancy and I want to give my landlord a Notice of Termination of Tenancy.
1.Considering the time in days that it takes to deliver( from central Tucson{my post office} to the foothills along Catalina Highway{my landlords residence}) a certified letter with return recipt requested, What is the soonest day and most legal date I can write down as my last day of tenancy if for instance I want to mail the notice on Wednesday 22 SEP 04? (What about Thursday 23 SEP 04 {just in case I need to wait a day or so to get good advice about the proper date})?
I would like to give him more than 30 days notice just to be safe, but I dont want to rush this notice and state the wrong date on it.
According to some information I have read:To terminate a month-to-month rental agreement, a landlord or a tenant must give 30 days notice in writing before the next rent payment would normally fall due. Today is 22 SEP 04 and my very next rent payment is due on 01 OCT 04.
30 days notice before 01 Oct is 01 SEP. I cant go back in time so what is the right "last date of tenancy" date to enter on the Notice of Termination?
I dont want to be charged by my (Vulture) landlord with failure to give sufficient notice of termination of tenancy by writing the wrong "last date of tenancy" on the notice. Then he might try to persue me in court for additional rent monies and late penalties, court costs etc. (and or many other horrors I probably cant even imagine)
Also I dont want to state a date past the proper or best "last date of tenancy" only to be held to that date and subject to owing additional rent monies. Or move out and be accused of abandoning the apartment( I really dont want to live here after 31 OCT anyway because I want to move into a {rental}house I found).
Please help me determine the proper date. I personally think it should be 31 OCT because it is 40 days from today (Wednesday 22 SEP) which makes it more than 30 days notice even with the certified mail return recipt requested "5 day notification" delivery(If notice is mailed by registered or certified mail, the tenant or landlord is deemed to have received such notice on the date the notice is actually received by him or five days after the date the notice is mailed, whichever occurs first). And I think it is 31 OCT because it is not 01 NOV which would be a new month ( I dont want to owe rent money for a month Im not living there especially after I turn the keys over to the landlord).

2.I listed my P.O.Box mailing address (because I dont ever recieve mail at my residence) on my Termination of Tenancy notice for my landlord to contact me to inform me of the date/time he/she intends to conduct a move-out inspection. Do I have to include a Phone number ? Do I have to inclue a pager /voice mail number?
I know I sound confused because i am and I have been told not to worry but each little thing can mean alot of money and consequences later.When you answer these questions, PLEASE be as detailed as possible and put it in the best plain speak as you can.
PLEASE answer these questions as soon as possible. I know you are swamped with tons of horror stories all day.

Lawyers here mostly represent landlords and the few that handle tennants want to be paid, wont answer general or technical questions or only help after a legal problem arises. JLG -------------------
