What is the name of your state? NY. Me and My x wife owned a business several years ago (7) and we owe about 12,000 dollars in back taxes on it. Since that time I have been on social security disablity and recieve less than 1200 dollars a month. Me and my girl friend bought a house a couple of months ago and I was wondering can the IRS sell it even if it is in her name too to pay the back taxes owed? Can I file bankruptacy and do away with this debt?What is the name of your state?

I hope that you are working on paying those back taxes to at least some extent. Yes, the IRS can place a lien against the home even though your girlfriend is a co-owner...and will. The IRS generally won't try to seize it to sell it, but they will put the lien in place to ensure that when you eventually sell the home, they will get their money, plus accumulated penalties and interest, out of your equity.
