My ex husband is behind in child support. One of my daughers went to live with him. She is 16. The other one lives with me. She will soon turn 18 & go off to college. What are my obligations? What are his? I live in Arkansas

My response:

Presuming you have a court order for child support, your obligation is to file a Petition for an Order to Show Cause, for collection of the arrearages - - again assuming you are within the statute of limitations. His obligation is to pay, or be cited for contempt of court on the original court order for support - - and, if his unwillingness to pay was malicious, then he could spend a few days in jail.

Any right to support payments, and arreages, are yours, and not the children's. That is, you must be the one to file your papers in court to make a claim.

IAAL,
When we went court over this, I was ordered to pay child support which is to be taken off his back child support after the older one turns 18. Not a problem. The problem I have is he is not obligated to pay the rest of the back until the 16 year old is 18 or out of HS.
