Back Child Support

What is the name of your state? Texas

If the NCP still owes back child support after the children have turned 18, will he/she still owe that money or will the debt just go away? Thank You.

No it doesn't go away, it stays where it is collecting interest until the CP decides to file.

That depends on if the ordering state has an SOL. Some do.. some don't. I cannot say for sure about Tx though right off the top of my head but it can be easily searched.

It doesn't gto away if there is a statute of limitations, but if the NCP dies before you can collect, and has no assets in their estate, you are SOL.

Isn't there something that you have to do within a certain length of time after the child reaches a majority age? something about turning it into a collection instead of child support arrearages??

Nope you do not do anything but try to collect it if you know where the person is. My father in law just went to jail last year for back child support and My wife is 30 now. He had to pay half to get out and agree to pay the rest in installments.

Wow, that's great to hear.

I have a friend whose ex owes her over 100K in back child support. The kids are in their 20's now. He left when the youngest was around 3. He would rather live on the street and work for cash than support his kids, and have a relationship with them.

They have nothing to do with him, and have made it known at major life events that he is to be removed from the premises if he somehow finds out and shows up.

It’s a mystery I’ll probably take to my grave, but how do people give up their children. My ew will probably end up like the Grandmother in “Pay It Forward”, living in a van down by the river.

That is the type of situation in which the NCP likely has no money or assets to go after.

And when tthey have no assets, an arrest and purge will ONLY work if there is someone else out there willing to come up with the money to pay the purge.

eh.. but sometimes it's not about the money and more about taking responsibility and punishment for those who refuse to take responsibility.

I don't know but they should make them watch home movies of their children growing up while they're there.
