I live in Maryland and had a child support case in Virginia. As time went on the Custodial Parent and I felt that we should do away with child support, stop acting like children and be adults about the situation. I now get to see my son an a regular basis and we did away with the " Child Support Obligation". We all get along alot better now and I feel a little more at ease giving my son what he needs and some of what he wants. I am giving more than what I was initially supposed to pay under the guidelines of Virginia. :) Now I have a question about the back Support that I had accrued when things weren't going so well between us. Am I still obligated to pay this back support or is there something that can be done since the child support order is lifted?

if it was a court order you are still obligated....if you were ordered to pay through the state the arrearages will remain in effect. If mom was ever on any kind of state aid you are going to have to pay those arrearages, no matter what. If mom wasn't, then maybe she can waive those arrearages, but it would depend on the judge.

The Cp can forgive you of those arrears and until that happens, you will continue to owe it.
However, if the CP has ever been on state aid, the state will make you pay it back as a reimbursement despite the cp wanting to forgive the debt.

I appreciate the advice and thoughts on that back support issue. I believe she may have used some assistance from the state but I am not sure. Guess I'll just have to ask her and go to the next step.
