I live in South Carolina. My ex-husband was ordered to pay me monthly a certain amount for marital debt,
which amounted to
the amount of my house payment. This was in Oct., 1995. According to him, he
wasn't able to do
it. I wasn't happy with my lawyer and couldn't afford another one. So, in
1998, he paid a lawyer
that finalized our divorce. From 1995 until it was finalized in 1998, he didn't
pay any of it,
which amounts to about $15,000.00 during that time. I almost lost my house, so
had to do some
other financing, which now when I make my house payment, it goes toward my
arrears. My ex is
getting married again this month. Would I be able to sue him for the amount he
never paid? I'm
thinking a judge might ask why I waited so long. I couldn't afford a lawyer.
Now that he is
getting married and might be able financially, am I entitled to this back pay?
In the final
divorce decree, this wasn't specified. But, it still was ordered initially.
