I would like to know the precise steps to take in order to obtain a judgment for back child support, so that I may have a bank account(s) garnished for the past due amount + interest and filing fees in the state of Washington.
I have a current order that stipulates $678 per month be paid. Nothing has been paid since the order was entered in May, next Tuesday the obligor will be 3 months in arrears.
He is employed in the state of Washington as a teacher. He is a resident of the state of Washington. He does have assets (bank accounts, retirement accounts, house, free and clear automobiles).
The order is in the process of being enforced by the state of Washington DCS, but they say it will take at least two more months to have it set up. By that time he will be 5 months in arrears.
His attorney advised him to not pay until it was withheld by DCS, and that way the arrearages could be paid at $50 per month. At that rate, my child will be 21 before it is paid back. I want to have his accounts garnished for the lump sum owing.
Can some one please tell me where to find the steps for this process?
Also, please don't tell me to hire an attorney, if I could afford one, I wouldn't be on this website.
