What is the name of your state? Ohio

My mother-in-law recently passed away. My husband and his siblings are the beneficiaries on her life insurance policy. Her husband is the sole-beneficiary of her estate. He has fired the executer of her will and has gotten his own attorney. We received these papers in the mail titled Waiver of Notice of Probate of Will, for him to sign. Do we sign?

You need a local attorney's advice about this so you will know if there is any advantage to you in doing so or not, or post your question to another free legal advice site called www.lawguru.com. You will need an attorney for consultation on other issues regarding this estate so you may as well get one now.

There is no way that the life insurance money you have received can be taken back by anyone else and your father has no right to ask for any of that money--if your mother had wanted him named as beneficiary she could have done so.

Father needs to decide whether he can afford to continue living in the home and making the monthly mortgage payments on it or if there is enough money in the estate to pay off the remaining balance. You have no rights to sell the home since you have legal authority or inheritance rights to do so--she gave it to HIM.

The estate is supposed to pay for the funeral home and medical bills, IF there is enough money in the estate to do so, but you probably want to go ahead and pay for that since that is what mother wanted, right?
