bad background check

What is the name of your state? ga My son recently applied for a job and they did a background check. Well according to the public records in baldwin county, he was convicted of driving with a suspended license, convicted and sent to jail for 90 days, dui, convicted 6 months probation, violation of probation, convicted and on a work crew for 12 months and also was convicted on suspended license again and reportedly in jail for 12 months as of 12-2004. Now for the past two years he has lived at home, maintained 2 jobs and been a fulltime student at GA Perimeter College, needless to say he made the deans list. Now he has lost the opportunity for a great job at Tmobile and possibly admission to UGA because of this. I contacted the Gwinnett County Police Dept. this morning and they were so great to me. My son has no record of DUI, nor 2 times suspended license in the State of GA or nationwide. He is not on probation, nor parole. I fell someone should be responsible for this mistake and this wont be easy to correct. Is this defamation of character and libel no we do not live in a trailer

I'm confused. Was your son convicted of these crimes or not in Baldwin county? If he was not, and it was the case of "mistaken identity" and he, in fact, has never had the alledged criminal record, he should go back to the employer who did not hire him based on the crim report and ask for the copy of his background check along with WHO conducted it (internally or 3rd party). If Report was prepared by a "CRA", Federal law mandates that he is allowed to see his background report if adverse action (not hired) was taken, among other pre and post adverse action notices he should have been given if he wasn't hired due to the background report.

If the employer did, in fact, use a CRA to obtain the background and your son was not given the proper notices, chance to dispute, etc..., pursuant to federal law, I'd be seeking an Employment Attorney!

The background check has EVERYTHING to do with CRA's, if they completed and reported an incorrect background check, thus erroneous criminal records, to the employer and caused the son to not be hired as a result of.

Companies whom conduct Pre-Employment Screenings ARE CRA's! Look it up <g>

WHOM? Go back to school

Pre-employment screenings are conducted by only a handful of firms, among them Kroll Inernational.

Geeez the troll gate is open again. :rolleyes:

Whom was a typo and there are hundreds of screening firms, Kroll being one of them. :rolleyes:
