What is the name of your state?VA Hello, I have written this question in another part of the forum, but didn't get any responses, except for a few from someone just wanting to put me down. Anyway, If a company owner writes a check that turns out to be bad, can the owner be pursued criminally or does the store or place where the check was cashed have to pursue the company through civil court? Also, if a company writes out its payroll checks, and they bounce, can the bank or the store that the checks were cashed in go after the owner and write of the checks criminally or do they have to pursue them in civil court? I have a store and a company has bounced several checks and I am trying to find out what route to take in getting my money back, and resolving the issue. I would appreciate any advice that I could get to help out. Thanks

My response:

Tell the truth.

You weren't being "put down". You were being instructed in the proper way to post a question because you posted in CAPITAL LETTERS, became defensive, and argumentative.

You're not getting any responses. You're done.

If you bounce a check, that could be prosecuted as a crime. (Some jurisdiction gives the writer of the check time to make it good.) In addition to the prosecution, the prosecutor may require that you pay "restitution" to the victim - the person you wrote the check too.

If you bounce a check, then the person you wrote the check to could file a civil action to recover their money.

So it can be both civil or criminal.
