My friend has been split up with his wife for about 4 months and hasn't seen his daughter since he left. His wife will not let him see her for no other obvious reason than her being mad because of them splitting up. He has a court order and will be filing a violation against her, and will also be filing papers to change it.....so my question is........She told him last night that before she lets her daughter around me, obviously because she's jealous that I'm friends with her husband, she would kill their daughter and herself. When they go to court and he brings that up.........will that help his case in any way????? Just thinking about saying something like that is just sickening!!!!

Unless you have third-party confirmation of such a statement, it's hearsay.

Okay, so what about her hearsay in calling the cops on him and filing charges saying he was going to kill her and their daughter?????.....which I know for a fact that he didn't say because I was there when he was talking to her. So now he has to go to court for charges that are false!

You know kel, I have asked you to stop posting so many threads and try to stick to one to get these issues resolved. The reason is that by posting so many issues all over this forum you dilude any help you might get on every issue.

It just so happens I have read all of your threads and so know a little about your issues. I chose not to answer until now because I just don't have the patience.

That being said, you need to quit playing attorney until you understand the underlying concept.

Heresay is the statement of a third-party (you) to the utterances of a party to the conversation. Unless you are actually a party to the conversation, you have no actual knowledge of what was said.

Her statements to the police are not heresay as they are her opinions and not those of a third-party. Whether they are lies or not is immaterial to the current discussion.

Well, if I would get answers from my threads I wouldn't have to keep posting different ones. And the threads I'm posting are not the same questions being posted over and over again.
