REally now, no on can tell you the answer to this question. You are going to have to make a judgment call on whether to file or not. Once you file, it is up to you to give proof. Many courts want to see that you acted outside the court to try and collect, my suggestion is to send certified RRR to debtor stating circumstances of loan and nonpayment, that you are giving them ____ days for payment, if none made, to court you will go.
See if they reply, acknowledge loan, etc. (that is good proof_
Once you file, many courts and I am not saying yours is one, will give you the judgment if they don't show or reply to court summons of your filing suit. So you would have a good chance to win, without really showing proof of said loan. Again, you will have to see what procedures are in your court.
