What is the name of your state (only U.S. law)? California

What IS bad faith?

Does it pertain to the insured?

Or to the person harmed for which a claim is made?

Bad faith usually refers to a company not fulfilling a contractual obligation it has to its own client. Third parties cannot usually bring bad faith claims because they have no contract with the company.
