Hello, my name is Monica and I live in Santa Clara, CA. My husband Paul and I rent the house we live in(everything is in our names). We have been there about a year and a half. Six months ago a "friend" of a "friend" needed a place to live so we let her move in.

We made her sign a month to month rental agreement with us as the renters and her the tenant, well things have not worked out and last month we gave her, her 30 day notice. She has until the 5th of July to be out.

What we were wondering is if she does not comply and get out by the stated date can we just put her stuff on the front porch and change the locks? We are not sure of the laws that apply for her as well as us,(it not being our house).

We want to make sure that we do not do anything that is illegal, and we do it the right way. I hope that if you can not help me, then you can refer me to someone that can. I have looked on the web and cant really find anything that would apply to our situation.

NO! As far as the law is concerned, you are her landlords & she is your tenant. (Assuming she has not signed a lease with your L.) You have to evict her using your state's eviction laws. You can buy an eviction kit from an office supply store or legal services company. The landlord's association may also have them. If you just change the locks you'll end up owing her beaucoup de bucks.

Thank you Tracay for clearing that up! As far as a eviction notice goes, afterI serve her she has three days to get out right?

What happens if she doesn't leave? Can I call the police and they will tell her to leave. Or do I have to do some other steps? I just want to make sure that I can get this person out of my house and that I am doing it the right way.
