Bad Roommate

I live in NYC with 2 roommates. The leaseholder roommate and myself are unhappy with our new roommate who moved in 4 months ago come Feb 1. Its mainly issues of his lack of consideration and responsiblity, although, one bigger problem is he announced to us he was giving copies of the keys to other tenants in the building, his friends, even though we do not want anyone else, especially people we don't know having keys to our "home". We have also brought up the other issues to no avail.

My question: Do we need to do more than ask him to leave with 30 days notice? Are there any other potential issues, ie. could he refuse and stop paying rent? The landlord is aware that the leaseholder has roommates.

We would like to do this the right way and before things get worse.

**A: read the L/T law and the principal tenant must give proper written notice of lease termination.

IF the roommate has NO written agreement with you, than you are out of luck as ONLY the LL can kick a tenant out once they have violated the terms of the lease...

Is that true even though this roommate is not on the lease?

Um this is not necessarily true. You could treat this person as a subletter, or at least the leaseholder can. Does he pay rent directly to the landlord or to the leaseholder?

He makes his rent check out to the leaseholder who in turn pays the landlord from his checking account.

The first 2 or 3 months he was more than a week late paying the leaseholder.

To sum up: Roommate has no written agreement w/the leaseholder or the landlord. Roommate is not on the lease.

When a discussion about his giving a set of apartment keys out to others turned heated (by his attitude of "thats the way its gonna be"), he said something about the neighbor who wasn't paying rent for months and still hasn't left and how he "wasn't trying to be that guy, but...."

What a mess!

I'm searching on nyc.gov and other related websites and I can't find anything specific. Thats how I turned up here.
Yes, we want to ask him to leave...want to do it the right way. Will give 30day written notice... I'm just wondering what may transpire, he seems to think he has more rights here than the leaseholder, how messy can this get?
