My husband and I wanted to book a last minute, short cruise for our April 11th anniversary. Around the end of March, on the company's website, we found a 3 night cruise departing on April 11th marked "Special pricing" for Deck 9 Oceanview price of $89 per person, $178 per stateroom. This price did not include taxes/port charges. I found many rooms available on their website and called to book this cruise. I spoke with representative who refused to honor this "special pricing" stating it must be "a computer glitch" and quoted me "the correct price of $900+" and informed they had several cabins available. I refused to book at this price knowing this was a bait & switch. I went back to the company's website and did a "print screen" of their advertised price of $178 total stateroom. One of the supervisors I spoke with stated they didn't care that I had printed proof of their pricing, she would not honor the price and that "this happens all the time".

I filed a complaint with the Better Business Bureau along with supporting documentation.
After 10 weeks of emails via the BBB, basically the only response from this company was "we are very sorry that the customer is unhappy".

The BBB has advised that I "may want to contact the State Attorney General's office to pursue this matter".

My question: Do I have any ground for legal action against this company ?? Any and all advise is greatly appreciated. Thank you.

No company is required to honor a mistake. I would bet somewhere on the website is a disclaimer saying they are not liable for errors. You suffered no damages, you don't have a case.

You didn't book the cruise. You're not out any money. You don't have standing to sue.

The BBB has no legal power to force a company to do anything. All you can do is hope that someone who wants to take a cruise will read the complaint you filed with the BBB and not book with them.
