Hi,

I have one question:

It’s legal to register a band name very identical to one that is already registered, only using a additional character like a hyphen ????


Example:

Reset (already registered Canadian band)

Re-set (name we want to register)

Witch are the juridical implications?

One of the tests used to determine whether or not trademark infringement has occurred is "likelihood of confusion". If somebody looks at the name and becomes confused as to the owner, infringement has probably occurred.

I'm not sure how something can be exponentially identical, seeing as 'identical' is a pretty strict one-way street, but I won't nitpick at you.

Is it legal to register a band name that way? I'm no expert in that field, by any means, but I don't see why it would be illegal. That's not to say that it couldn't be challenged in the future, and that you don't face any risk of potential trademark infringement or risk of being forced to change the name at some point.

Common sense should tell you that if registering the name would be illegal, then whomever you'd be registering the name with wouldn't allow you to do so to begin with. That same common sense should tell you that, illegal or not, you're not very likely to face any real consequences for attempting to register a band name that's similar to one that's already registered.
