I live in Arizona. my paycheck was due to be deposited on friday, 7/13 but was not due to a bank error. this was company wide - not just me. the bank assured all of us our funds would be available by the evening of the 13th but they were not actually deposited until monday the 16th. they have agreed to cover all nsf charges i've incurred, however, i want to sue them for 'pain and suffering' due to the humiliation of my bank card and check being declined at the grocery store and being without funds for the entire weekend. do i have a case at all and if so, what kind of lawyer would i need and what are my chances of actually winning a settlement?
