What is the name of your state (only U.S. law)? California
bank of america just called and said they will sue me by 2pm if I dont call them regarding a credit card I havent paid. I actually spent 3800 on the card back in 2003 and its now up to 10.000. what should I do? try to settle and for how much? or should I go through with the law suit. I barely make enough to eat right now. I have been ignoring their calls and now they called my parents back in texas and they are threatening to sue me, I dont barely make enough to survive. How can I fix/settle this prblem?

You never should have ignored them to begin with. Call them and see what happens.

You say: "Okay. I'll see you in court."

If they don't sue you by 2 p.m., then you sue them for the FDCPA violation.

Zig, don't you think the conversation went more like "If you don't call by 2pm, we will sue you"?

takash, you shouldn't have ignored them - they will sue you. You may not have anything today; but, you'll have it in the future. A judgment lasts a long time. During that time the amount you owe will increase exponentially.
