My landlord is filing backruptcy. I want to move out of the house and closer to work. I am going to tell her that I want out of the lease. Can she legally stop me from moving considering that the bank will take possession of the house? And if so, how can I fight her and get out of the contract? Since she can't have any income she told me she is going to use my security deposit for rent this month. Can she do that without my permission?

Well she has given you what you wanted.

WRITE the landlord a letter send it certified mail return reciept, TODAY...and keep a copy for youself..stating that by the LANDLORD making the decision to use your security as the last months rent, because she doesnt want to show any income, for her bankruptcy, she has effectively terminated the lease, and has given you your 30 day notice to vacate, and you agree to this , and that you will be out of the apartment by march 31st.

Dont forget to take lots of pictures of the apartment before you leave and hand her the keys, just in case she tries to sue you for any damages.
