What is the name of your state? PA

Is it possible for a spouse to claim bankruptcy in a divorce action, forcing her husband to either #1 file bankruptcy with her or #2 take over her debt? Credit cards are in both husband and wife's names. Just wondering if this is allowed.

Please post this question on the "bankrupcy forum" if you haven't so already.

The quick and dirty answer is yes, this is possible, but any bankrupcty action will probably have to put off until the final property division. Then the "ex" who's filing should name the other "ex" as a co-debtor and creditor. This is why so many times when one "ex" files over lots of joint debt, the other one often has to as well, resulting in two bankruptcy actions.
