What has the Attorney said - admitted?
If they agree and take responsibility for the oversight, they'd likely agree to pay the court fee - and waive their fee.
If they don't agree...ummmm.
Need to have a civil discussion with your attorney...present whatever proof you have....and give them the opportunity to do the right thing.
If you can't make a logical and reasonable case to your attorney -- they're not likely to take any responsibility. Would you?
If you present your facts/evidence -- and your attorney doesn't come around: Tactfully let them know that you intend to file a grievance/complaint with the State Bar Assoc.
They'd much rather cover the court fee than waste serious billable hours on the grievance/complaint.
Keep in mind, if you can't prove fault -- you're just spinning your wheels.
Better to play nice with your attorney -- and get that discharge.
