florida-friend,filed chap.13. hasn't had day in court. can she stop the motion now. and will they return her monies already paid in $313. x 7 months. plus she has a law suit claim of $14000. they are holding. will they return this, as she has not had a court hearing, and they are not going to allow chap. 13 because she is late on the last two months of chap. 13 payments. and two house payments. she wants to refile chapter 7. if they release the monies she can pay up her house payments, so she can keep her house.

Okay,obviously there is a reason why her Chapter 13 filing is being denied. She can't just cancel and go on her merry way. There are ways to switch to Chapter 7 but get a lawyer -- a bankruptcy attorney to help.
